Howard & Byrne has an experienced, dedicated and hard working prison law team, who have significant experience with indeterminate and extended determinate sentenced prisoners (Lifers and EDS).
We regularly appear in front of the Parole Board; we work with highly specialised psychologists and seek to build comprehensive and persuasive applications for release. We can also cover most prisons due to video link conferencing availability.
Our thorough and detailed approach means clients feel well prepared for hearings, understanding the test for release and the Parole Board approach.
We regularly deal with recall cases (both determinate, extended determinate and indeterminate prisoners), all work regarding life sentenced prisoners including Parole Board hearings, applications for release, open conditions, pre-tariff sifts and early review of life sentences 5 years before tariff expiry for those who are said to be “treading water.”
We can also assist with sentence calculation and Category A reviews in addition to prison adjudications in front of an independent adjudicator.
Legal aid is often available to cover our work, but we also work on a private fee basis for areas outside of legal aid scope or where ineligibility is based on means.
Our team have a particular interest in IPP and automatic life sentences and work with specialist counsel to review and pursue potential appeals against these types of sentences.
We also work closely with clients on psychologically informed units such as progressive regimes, PIPE units and therapeutic communities, using the detailed understanding of the individual cases so we can challenge the evidence and the way they are applied.
